GPS Attendance and Employee Privacy in India

A practical overview for employers. This is not legal advice.

Updated · Preez, by ILA Platforms

Short answer: Location-based attendance can respect privacy if it collects location only when an employee checks in or out, tells staff exactly what is collected and who can see it, and keeps evidence private. India’s Digital Personal Data Protection Act, 2023 generally expects organisations to give notice and use personal data for a stated purpose. Take legal advice for your situation.

Collect only what attendance needs

CollectAvoid
Location at the moment of check-in and check-outContinuous or background location during the day
A photo at check-in, for a person to reviewBiometric templates you do not need
Times recorded by the serverContacts, files or other phone data

Tell staff before you start

  • What is collected: location at check-in and check-out, a selfie, times.
  • Why: attendance and resolving disputes.
  • Who can see it: owners, admins and their branch manager.
  • How long it is kept, and how to ask for corrections or deletion.

In Preez, employees can open a Privacy screen in the app that states location is collected only when they mark attendance and that their employer can view the evidence.

Keep evidence private

  • No public links to selfies; access only for people who need it.
  • Limit managers to their own branches.
  • Keep an audit trail of changes.

Frequently asked questions

Is GPS attendance legal in India?

Location-based attendance is widely used by Indian businesses. Data protection law, including the DPDP Act, 2023, focuses on notice, purpose and safeguards. Take legal advice for your organisation; this guide is not legal advice.

Should attendance apps track employees all day?

For ordinary attendance, no. Reading location only at check-in and check-out is enough and is easier for staff to trust.

Can employees see what Preez collects?

Yes. The app has a Privacy screen stating what is collected and that the employer can view attendance evidence.
